Pacific Islands Freight Services

These Terms & Conditions (“Terms”) govern all services provided by Pacific Islands Freight Services (“PIFES”, “we”, “us”, or “our”) to any customer (“Client”, “you”, or “your”). By engaging our services, you agree to be bound by these Terms.
1. Scope of Services
Pacific Islands Freight Services provides freight forwarding, logistics coordination, shipping documentation, customs facilitation (where applicable), and related services by sea, air, and land. We act as an agent, unless expressly stated otherwise in writing.
2. Quotations & Rates

All quotations are estimates only and subject to change without notice.

Rates may vary due to fuel surcharges, currency fluctuations, port charges, customs duties, taxes, or unforeseen operational costs.

Quotes are valid only for the period stated and are based on information supplied by the Client.
3. Payment Terms

Payment terms are cash before release, unless a prior credit agreement is approved in writing.

Invoices must be paid in full by the due date stated.

Late payments may attract interest, collection fees, and suspension of services.

All charges must be paid regardless of shipment delays or third-party issues.
4. Client Obligations
The Client warrants that:

All shipment details are accurate and complete.

Goods are properly packed, labelled, and compliant with applicable laws.

Goods are not dangerous, prohibited, or restricted unless declared and approved in writing.

All necessary licenses, permits, and documentation are provided.
5. Customs, Duties & Taxes

Customs clearance services are performed as an agent only.
-
The Client is solely responsible for all duties, taxes, penalties, fines, or delays imposed by customs or authorities.

Any additional costs incurred will be charged to the Client.
6. Dangerous & Prohibited Goods

Dangerous, hazardous, or restricted goods must be declared in advance.

PIFS reserves the right to refuse, destroy, or dispose of undeclared or prohibited goods at the Client’s expense.

The Client indemnifies PIFES against all losses arising from non-compliance.
7. Insurance

Cargo insurance is not included unless expressly arranged in writing.

We strongly recommend Clients obtain adequate insurance coverage.

If insurance is requested, PIFES acts only as an agent and assumes no insurer liability.
8. Liability & Limitation

PIFES is not a carrier and does not accept carrier liability unless stated.

Liability, if any, is limited to the lesser of:

The value of the goods, or
-
The amount recoverable under applicable international conventions.

We are not liable for indirect, consequential, or economic losses, including loss of profit or delay.
9. Delays & Force Majeure
PIFES is not responsible for delays or failures caused by events beyond our control, including but not limited to:

Weather, strikes, port congestion
-
Acts of government or customs
-
War, natural disasters, or pandemics
10. Storage & Abandoned Goods

Storage charges apply if goods are not collected within the agreed timeframe.

Goods unclaimed after 30 days may be sold or disposed of to recover costs.

Proceeds (if any) after deductions will be returned to the Client.
11. Indemnity
The Client agrees to indemnify and hold harmless Pacific Islands Freight Services from all claims, losses, damages, penalties, or expenses arising from:

Incorrect shipment information
-
Breach of these Terms
-
Violation of laws or regulations
12. Right of Lien
PIFES has a lien over goods and documents for unpaid charges and may retain or dispose of goods until all amounts are settled.
13. Termination
We may suspend or terminate services immediately if:

Payment obligations are not met
-
False or misleading information is provided
-
There is a breach of these Terms
14. Governing Law
These Terms are governed by the laws of both Australia, Fiji and the relevant Pacific Island countries, and the parties submit to the exclusive jurisdiction of its courts.
15. Amendments
Pacific Islands Freight Services reserves the right to amend these Terms at any time. Updated Terms will be effective upon publication.
